Ruled in favour of Jeewan Singh (Petitioner)
In Short
A paramilitary soldier was denied a promotion and saw his seniority slashed after a surprise medical report claimed he was permanently unfit, even though he was never actually examined. The Punjab and Haryana High Court stepped in to protect his rights, finding that the adverse medical report was conducted without examining him and holding that he should not suffer for administrative delays.

What the Case Was About
The petitioner joined the Indo Tibetan Border Police Force as a Constable in 1986 and steadily rose through the ranks, eventually becoming a Havaldar. In 2010, he fell ill and was placed in a temporary low medical category for 24 weeks. Although a review medical board was due in October 2010, the authorities delayed conducting it for a long time. When he was finally examined on May 7, 2012, a medical board and the sector chief medical officer declared him fully fit and upgraded him to the top fitness category, SHAPE-I.
However, just fifteen days later, a special medical board was allegedly held behind his scenes without examining him, which categorized him as permanently unfit and recommended that he be boarded out of service. Later, he was once again declared fit in 2013 and eventually promoted, but his seniority was drastically dropped from serial number 81 to serial number 1768 based on that flawed May 2012 report. He approached the High Court to challenge this unfair demotion in his seniority and to seek his rightful promotion benefits.

The Outcome
The court ruled in favour of the petitioner, setting aside the unfair treatment and protecting his legitimate service seniority.
What the Court Looked At
- The court noted that according to the force's standing orders, personnel in a temporary medical category can appear for promotion tests and maintain their seniority if upgraded within a year.
- The court observed that the petitioner was indeed declared fit and upgraded to SHAPE-I by a proper review medical board on May 7, 2012.
- The court highlighted the stunning admission by respondent No. 5 that the petitioner never even signed the subsequent May 23, 2012 medical board proceedings, proving he was never physically examined.
- The court recognized that the authorities unfairly used a ghost medical report to slash the petitioner's seniority from serial number 81 down to 1768.
"It is further admitted by respondent No. 5 that the petitioner did not sign medical board proceedings which shows that the petitioner was never examined."
