What the Case Was About
The claimant worked as a laborer on a tractor and trailer. On December 16, 2011, he and other workers cut bamboo trees and loaded them onto a trailer attached to a tractor. While riding on the loaded trolley, the connecting hook suddenly broke. The driver lost control, the trolley separated, turned turtle, and fell into a ditch. The claimant was crushed underneath, suffering severe fractures and injuries to his left foot, knee, and hand. Because of the severe trauma, his left foot had to be amputated below the knee. The unfortunate driver of the tractor also passed away in the accident. Seeking justice, the injured laborer filed a claim for compensation, which eventually led to this appeal over the adequacy of the award.

The Outcome
The court ruled in favour of the appellant-claimant, increasing his assessment of functional disability to 100 percent and directing a higher calculation for his future loss of earnings.
What the Court Looked At
- Considered the medical evidence showing fractures to the left humerus, wrist, knee, and tibia, alongside the below-knee amputation of the left foot.
- Rejected the defense argument that the claimant could still perform light alternative work, noting the reality of manual labor vocations.
- Noted that for manual workers and heavy vehicle cleaners, losing a leg completely destroys their ability to perform their primary livelihood.
- Applied the established legal principle that functional disability must be measured by the actual impact on the specific job the victim performed.
- Cited previous High Court and Supreme Court precedents establishing that severe limb amputation in physical jobs equals a total loss of earning capacity.
"A heavy vehicle cleaner or second driver cannot perform his primary vocation without a functional leg."
What This Means For You
If you work in physical, manual, or labor-intensive jobs, a permanent injury like a leg amputation completely alters your ability to earn a living. The insurance companies or lower tribunals may try to argue that you can still do minor desk or light tasks, but the courts recognize that real-world manual jobs demand full physical fitness. If an accident robs you of your livelihood, you are entitled to claim compensation based on total loss of earning capacity rather than a partial percentage. Understanding your rights can help you fight for fair financial support when life deals you an unexpected blow.
