Appeals allowed in part — mixed ruling on compensation and liability
In Short
Five members of a single family tragically died when their car crashed into a heavy truck parked illegally and without lights on a highway during the dead of night. The motor accident claims tribunal awarded compensation to the grieving family members, but both the insurance company and the victims' families challenged those amounts in the High Court. The High Court reviewed the case to decide on truck driver negligence, driving license validity, and the correct financial compensation for the lost lives.

What the Case Was About
In August 2009, five family members were traveling in a car from Kathua to Haridwar to carry out the last rites of a deceased family member. Around three in the morning near Mandi Gobindgarh, their car crashed into the back of a large truck-trailer that was parked in a no-parking zone on the road without any tail lights, reflectors, or warning signs. All five occupants of the car died right at the spot. The relatives of the deceased filed four separate claim petitions asking for financial compensation, leading to multiple appeals and cross-appeals before the High Court.
Judgment Date
22 September, 2026
The Outcome
The court held the truck driver entirely responsible for the fatal accident due to dangerous and negligent parking. The court rejected the insurance company's arguments regarding contributory negligence and license invalidity while adjusting and addressing the compensation amounts across the connected appeals.
What the Court Looked At
- The court noted that an independent eye-witness confirmed the truck was parked in the dark without any parking lights or warning signals.
- The court rejected the truck driver and owner's shifting claims because they contradicted their own initial written statements filed in court.
- The court found that photographs presented by the defense were taken hours after the crash and had no reliable evidentiary value.
- The court observed that leaving a heavy vehicle unlit on a highway at night is negligence by itself.
- The court dismissed the insurance company's claim that the car driver was also at fault for hitting a stationary vehicle.
"A heavy vehicle left standing on a public road, and particularly on a national highway, during the hours of darkness, without any tail-lamp, reflector, indicator or warning flapper, and in a no-parking zone, constitutes negligence per se."
